Asbestos attest when selling: Flanders, Brussels, Wallonia
Asbestos was used in construction until it was banned in 2001. The obligations on sale differ by region.
Flanders
Since 23 November 2022, selling a building constructed before 2001 requires an asbestos attest drawn up by an OVAM-certified expert.
Brussels and Wallonia
Our rules know no general asbestos attest required on sale in these regions today (to be verified with the notary, the rules are changing). An inventory remains useful for an older property.
What the tool checks
Asbestos found or not, an asbestos-free attest for a pre-2001 building (a point of attention), an attest dated after the signature, a missing document in Flanders.
Frequently asked questions
Does a building from after 2001 need an asbestos attest in Flanders?
In principle no: the obligation covers buildings from before 2001 (to be confirmed by the permit date).
What if the attest reports asbestos?
Have the removal or management of the materials priced and take it into account in the price.
